CORD – TERMS OF SERVICE – CANDIDATES

  1. Welcome
    1. This document and any documents referred to within it (collectively, the "Terms of Service") set out the terms of your relationship with us when you access and use our website (www.cord.co) and the Service (as defined below) as a candidate. It is important that you read and understand the Terms of Service before using the Service. If you are an employer, you must agree to our Employer Terms of Service before using the Service.
    2. You must accept these Terms of Service before you sign up for, use and access the Service as a candidate. If you do not agree to these Terms of Service, you cannot use the Service.
    3. All other use of our website is subject to our Website Terms of Use.

      To make it easier for you to navigate these Terms of Service, we have split them up into three sections:

  2. PART A: INTRODUCTION

  3. Information about us
    1. Co-Hire Ltd. is a company registered in England and Wales (company number: 10187744) with its registered address at 134 Tooley Street, London, England, SE1 2TU ("cord," "we", "our", or "us").
    2. cord is a messaging tool for finding work. It gives prospective candidates and employers direct access to one another. We make it available through our website, www.cord.co (the "Service").
  4. Information about you
    1. Your privacy is important to us. Please read our Privacy Policy to understand how we collect, use and share information about you.
    2. When you use the Service to view, send, store or receive information (including CVs and messages), cord may use such information for its own internal purposes, including (without limitation) to perform data analysis and quality control, as well as to improve the Service.
  5. PART B: CANDIDATE-SPECIFIC PROVISIONS

  6. Your rights to use the Service
    1. When you access the Service, you will be able to register and create an account, subject to the provisions of this clause 4.
    2. We reserve the right, in our sole discretion, to accept or reject your registration to use our Service, in particular after having consulted any information about you that is publicly available. If your registration is accepted, you will be allowed to use our Service. We have the right to suspend or terminate your account and refuse any and all current or future use of the Service at any time and for any reason. We reserve the right to request at any time a document proving your identity.
    3. The Service is intended for business and professional use only and is not suitable for use by individuals in their personal capacities. You agree not to create an account or use the Service if you have been previously removed by us, or if you have been previously banned from the Service.
    4. You must be at least 18 years old, capable in your country of residence of entering into a legally binding agreement and meet any eligibility requirements that we publish on our support hub (which we may change from time to time) in order to use the Service.
    5. The materials and content comprising the Service belong to us or our third party licensors, and we hereby give you permission to access, view and use these materials and content for the sole purpose of using the Service as a candidate in accordance with these Terms of Service.
    6. Your right to use the Service is personal to you and you are not allowed to give this right to any other person. Your right to use the Service does not stop us from giving other people the right to use the Service.
    7. You acknowledge and understand that we have no control over the content of job recommendations listed on the Service, links to or from such job recommendations, or any conditions which third parties might impose on you as a candidate if you submit an application.
    8. Unless allowed by these Terms of Service and as permitted by the functionality of the Service, you agree:
      1. not to copy, or attempt to copy any portion of the Service;
      2. not to give or sell or otherwise make available any portion of the Service to anybody else;
      3. not to change, or attempt to change any portion of the Service in any way; and
      4. not to look for or access the code of any portion of the Service that we have not expressly published publicly for general use.
    9. If you perform any unauthorised processing of information (including by breaching section 4.9 above), it will be deemed a material breach of these Terms of Service and we may suspend or terminate your access to the Service in accordance with section 7.2.
    10. You agree that all confidential information, copyright and other intellectual property rights in the Service belong to us or the people who have licenced those rights to us.
    11. Other than as set out in these Terms of Service, we do not give you any other rights in the Service. You agree that you have no rights in or to any portion of the Service other than the right to use it in accordance with these Terms of Service.
  7. Your content
    1. You confirm that any images, text, documents or information that you upload to the Service, including any feedback or comments that you submit to us (collectively, your "User Content") will not breach the Rules of Acceptable Use.
    2. Our right to use your User Content does not in any way affect your privacy rights. Please see our Privacy Policy which provides information on how we use your personal information.
    3. When you upload or post User Content to the Service, you grant us a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, and display such user-generated content in connection with our products and services.
    4. We do not monitor, approve or take responsibility for content uploaded to the Service by other users, including prospective employers and candidates. If you wish to make a complaint about any user content on the Service, please contact us at support@cord.co.
  8. Rules of Acceptable Use
    1. In addition to the other requirements within these Terms of Service, this section 6 describes specific rules that apply to your use of the Service (the "Rules of Acceptable Use").
    2. When using the Service you must not:
      1. aggregate, copy, reproduce, distribute or re-sell any content on the Service;
      2. give any false or misleading information, impersonate any person or hide or attempt to hide your identity;
      3. act in any way that breaches any applicable local, national or international law or regulation nor advocate, promote or engage in any illegal, fraudulent, harmful, indecent or unlawful conduct (including in your user-generated content), including any criminal activity, abusive, discriminatory, threatening, invasive or offensive behaviour, use of harmful, violent or sexually explicit content or imagery, or any other conduct that, in cord's opinion, causes or is likely to cause harm, damage or injury to any person or property;
      4. introduce viruses, Trojans, worms, logic bombs, invalid data or any other material which could harm the Service or any underlying software or equipment;
      5. collect any data from the Service other than in accordance with these Terms of Service (including by any automated or non-automated "scraping" or data mining etc.);
      6. violate or attempt to violate the security of our site including attempting to prove, scan or test the vulnerability of a system or network or attempt to breach security or authentication measures;
      7. use any automated system, including without limitation "robots", "spiders" or "offline readers" to access the Service in a manner that send more request messages to the Service than a human can reasonably produce in the same period of time;
      8. upload, download, send, knowingly receive, use or re-use any material which does not comply with the content standards set out in these Terms of Service or otherwise made available by us at any time; or
      9. procure the sending of, or transmit, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation.
    3. The Service must not be framed on any other site, nor may you create a link to any part of the Service other than the home page. You may link to the Service home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association with or approval or endorsement by cord where none exists. You must not establish a link to our site in any website that is not owned by you.
    4. Failure to comply with the Rules of Acceptable Use constitutes a serious breach of these Terms of Service, and may result in our taking all or any of the following actions (with or without notice):
      1. issuing a warning to you;
      2. immediate, temporary or permanent withdrawal of your right to use the Service;
      3. legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; and/or
      4. disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
  9. Ending our relationship
    1. If at any time you do not feel that you can agree to these Terms of Service or any changes made to the Terms of Service or the Service, you must immediately stop using the Service.
    2. We may immediately suspend your account or end your use of the Service if you break the Rules of Acceptable Use or any other important rule(s) or terms we set for accessing and using the Service including these Terms of Service.
    3. We may also withdraw the Service at any time provided we give you reasonable notice that we plan to do this.
    4. If you or we end your use of the Service or we withdraw the Service as described in this section 7, you will lose any rights you have to access and use your User Content on the Service and any other portion of the Service. You should therefore ensure that you keep a copy of any information or User Content you use or upload to the Service (for example, your CV), as we will not offer you compensation for any losses you might suffer if you lose your rights to access and use the Service or any other information available through the Service.
    5. Nothing in this section 7 affects any legal rights you may have under the law of the country in which you are resident.
  10. Security
    1. We care about the integrity and security of your personal information. However, we cannot guarantee that unauthorised third parties will never be able to defeat our security measures or use your personal information for improper purposes.
  11. Links to third party websites and information
    1. The Service may contain links to third-party materials that are not owned or controlled by cord. If you access a third-party website or service from the Service or share your User Content on or through any third-party website or service, you do so at your own risk, and you understand that these Terms of Service and our Privacy Policy do not apply to your use of such sites.
  12. PART C: GENERAL

  13. Our responsibility to you
    1. Certain features of the Service may rely on networks and connections that are beyond our control. As we do not own or operate such third-party networks, we cannot be responsible for them in any way.
    2. We shall not be responsible to you for any claims arising out of the provision of the Service. The Service, and all content on the Service is provided for informative purposes only and on an "as available" and "as is" basis. This means that:
      1. we are unable to promise that your use of the Service will be uninterrupted, secure, without delays, error-free or meet your expectations;
      2. we do not promise that any defects or errors will be corrected, or that the Service (or any content available to view or download on the Service) is free of viruses or other harmful components; and
      3. information about our products and services that is made available through the Service may change as we continue to develop these products and services.
    3. In these Terms of Service, we do not give any commitment relating to the performance or availability of the Service, or the suitability or accuracy of the content made available through the Service.
    4. In every case, we will never be responsible for any loss or damage that is not reasonably foreseeable, or that is caused by a failure by you to comply with these Terms of Service. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you agreed to these Terms of Service, both we and you knew it might happen.
    5. The above does not affect your rights under the applicable law of the country in which you are a resident, including our responsibility to you for any personal injury or death caused by our negligence.
  14. Resolving disputes
    1. If you have a dispute with us relating to the Service, in the first instance please contact us at support@cord.co and attempt to resolve the dispute with us informally.
    2. In the unlikely event that we have not been able to resolve a dispute informally, we will discuss and agree with you on the most effective way of resolving our dispute.
    3. If you are in the European Economic Area, you may (but are not obliged to) seek resolution of any dispute with us through consumer mediation services. You can do this through the European Online Dispute Resolution (ODR) platform, available at this link: https://ec.europa.eu/consumers/odr/.
    4. Nothing in this section 11 affects any legal rights you may have under the law of the country in which you are resident.
  15. Changes to the Service
    1. We are constantly updating and improving the Service as our products and services develop. Improvements and updates are also made to reflect changing technologies, tastes, behaviours and the way people use the Internet and the Service.
    2. In order to do this, we may need to update, reset, stop offering and/or supporting a particular part of the Service, or feature relating to the Service ("changes to the Service"). These changes to the Service, which may occur with or without prior notice, may affect certain features and content available through the Service, including deleting and/or removing such content and features.
  16. Changes to the documents
    1. We may revise these Terms of Service from time to time but the most current version will always be at [https://cord.co/candidate-terms]. Normally, we will try to give you some warning before the new terms become effective. However, sometimes changes will need to be made immediately and if this happens we will not give you any notice.
    2. Every time you wish to use the Service, please check these terms to ensure you understand the terms that apply at that time.
    3. Your continued use of the Service after we make any changes to these Terms of Service will indicate that you have agreed to those changes. If you do not agree to any of the changes to these Terms of Service you should not use or access (or continue to use or access) the Service.
  17. Documents that apply to our relationship with you
    1. The then-current version of the Terms of Service contains the only terms and conditions that apply to our relationship with you at any time.
    2. We intend to rely on these Terms of Service as setting out the written terms of our agreement with you for the provision of the Service. If part of the Terms of Service cannot be enforced then the remainder of the Terms of Service will still apply to our relationship.
    3. If you do not comply with these Terms of Service and we do not take action immediately, this does not mean we have given up any right we have and we may still take action in the future.
  18. Law
    1. These Terms of Service, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England.
    2. This does not affect your rights under the law of the country in which you are resident, including your right to have a dispute in relation to your use of the Service heard in the courts of that country. If you are in Scotland or Northern Ireland, this means that you can also have your dispute heard in the Scottish or Northern Irish courts.

    2. We value hearing from our users, and we are always interested in learning about ways we can improve the Service. By providing your feedback you agree that you are giving up any rights you have in your feedback so that we may use and allow others to use it without any restriction and without any payment to you.
